Adverse Possession Claims
Have you occupied, maintained and treated a piece of land as your own for many years? If so, you may be able to claim legal ownership of it through adverse possession.

In some circumstances, you can apply to HM Land Registry to register land in your name, even if you can’t prove that you’re the legal owner. Claims often come up when homeowners have extended their gardens beyond the legal boundary, farmers have used neighbouring land, or someone has maintained and controlled land without challenge for many years.
When you apply, HM Land Registry will usually notify the registered owner and give them a chance to object. We can help you put together a strong application, respond to any objections and work through the process with you.
How we can help
We can:
- Review Land Registry records and title documents
- Assess whether you meet the legal requirements for adverse possession
- Help you gather evidence of your occupation and use of the land
- Prepare witness statements, plans and supporting documents
- Submit your application to HM Land Registry
- Advise and represent you if another party objects to your claim
Every claim turns on its own facts and evidence, so the sooner we can look at yours, the better.
Some people come to us because their garden has taken in land beyond the legal boundary for years. Others have farmed or used a neighbouring strip of land without challenge and want to make that ownership official. Whatever your situation, we’ll assess it honestly and tell you where you stand.
If you’re not sure which of these fits your situation, call us, and we’ll point you in the right direction.
